Since this has made the news, Malibu has released an official statement:
“Malibu Health Products Ltd. is a responsible company supplying low cost Sun Protection to the European and global markets. We manufacture according to the EU Cosmetics Regulation (EC) No 1223/2009.
We hold the Product Information File which includes all necessary documentation including the Safety Assessment, InVivo (SPF) Test Report, InVitro (UVA) Test Report which prove the labeling claims we make.
All products have been tested to the relevant Colipa recommendations and always at Independent Laboratory facilities in the UK.
The product in question [Maibu Sun Lotion SPF 30 200ml] which was tested in 2002 has been on the market for 12 years during which time we have had an exceptionally low level of complaint, even when bogus claims and misapplication are included, and we had zero complaints last year (2013) for this product.
Any authorised body or applicant with a reasonable case is able to view this documentation upon request.”
Piz Buin, also accused of the same thing, commented:
“As with biological tests, we know there can be variability in test results between laboratories.”
